Dear Mr. Marco Balmelli
In respect of the right decision from 2nd of August 2013 taken by you as the Sole Arbitrator of CAS, please kindly allow me to inform you about the following collateral damages:
- F.C. Rapid S.A. as affiliated part of FRF, in order to avoid any potential financial penalties and sport suspensions, accepted and participated to the knockout game against C.S. CONCORDIA CHIAJNA. Taken into consideration that the above mentioned game was organized by FRF without any regulatory basis, we keep our confidence that the operational costs paid by F.C. Rapid S.A., must be, taking into account the principles of the RESPECT, refunded by FRF;
- F.C. Rapid S.A., signed new contracts to compete in Liga 1. F.C. Rapid S.A. is forced, following to this knockout game organized by FRF without a regulatory basis, to face ALONE with the termination of these contracts or with the corresponding payments fulfillment for at least one year. Considering that the only fault of the F.C. Rapid S.A. was to won this illegal game, we keep our belief that any liquidated damages of these contracts must be refunded by FRF;
- F.C. Rapid S.A., sold till the CAS’s decision from 2nd of August 2013, 1 year subscriptions for his fans. Beyond of this strange situation which could affect the psychological health of his fans, we believe that at least FRF must send to F.C. Rapid S.A. and his fans, a public apologies letter;
- F.C. Rapid S.A. already signed a sponsorship contracts valid for Liga 1. F.C. Rapid S.A., is unable to carry out its obligations under this agreement due to circumstances beyond its control and following to this illegal decision taken by FRF. There are no doubts that any potential liquidated damages of this contract must be refunded by FRF;
- F.C. Rapid S.A. played 2 games in Liga 1. We keep our confidence that the already paid operational costs, must be only into FRF’s account;
- F.C. Rapid S.A. is threatened by FRF (Mr. Mircea Sandu) and LPF (Mr. Dumitru Dragomir) with the ABOLITION in case if F.C. Rapid S.A. will ask for any help or justice at CAS, UEFA or FIFA (my reason to copy these respectable forums in my correspondence).
- Against all of these injustices mentioned on above and done by FRF, the fans of F.C. Rapid S.A. starting with today 7th August 2013 18h will enter into a HUNGER STRIKE.
Keeping my confidence that you, CAS, UEFA and FIFA will invest the necessary efforts and time for avoidance of any more injustices done by FRF, please allow me to thank you in advance for the corrective actions and immediate regulations taken to the sport and humanity benefit.
